Key Definitions

Data Controller – OMS Ltd., reg. No. LV 42103000774, Construction merchant reg. No. 0365-R, 12–1 Lielā Street, Grobiņa, Dienvidkurzemes Municipality, LV-3430
Latvia, hereinafter referred to as “OMS”.

Client – a natural person who has entered into an agreement with “OMS” and who uses, has used, or plans to use the services, or a beneficiary, third party, or any other person otherwise connected with services provided by “OMS”.

Personal Data – any information relating directly or indirectly to a Client that can identify them as a natural person.

Processing of Personal Data – any operation or set of operations performed on personal data, including collection, recording, storage, modification, access, sending requests, transfer, etc.


1. Purposes of Personal Data Processing and Categories of Personal Data

We process personal data only for predefined purposes to conclude and execute agreements related to training, occupational safety supervision, and other services associated with concluded agreements: to identify you, obtain information about the surveyed object, provide other related actions (including sending invoices), communicate with you regarding contract execution or unplanned work.

We may also need personal data for other purposes, for example:

Direct marketing purposes – to provide you with information about offers, special promotions, and other marketing communications. Your personal data will only be processed for direct marketing purposes if you have given your consent, or if it is necessary for the legitimate interests of “OMS”.

Your personal data processed by “OMS” is obtained in the following ways:

  • You provide it (by filling in and submitting an online application, calling the customer service phone number, visiting customer service centers);

  • You provide data for identification related to contract execution on behalf of a third party;

  • You provide data for identification related to contract execution;

  • You provide personal data for employment contract conclusion.

Depending on the agreements concluded between “OMS” and the Client or individual, “OMS” collects and processes various personal data. The main categories include:

  • Personal data directly related to identity, such as name, surname, personal identification number, date of birth, property identification;

  • Contact information, such as address, email, phone number;

  • Professional information;

  • Data related to special identification;

  • Special categories of personal data – health data.


2. Legal Basis for Personal Data Processing

When processing personal data, “OMS” complies with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and the free movement of such data) and other applicable EU or Latvian laws.

“OMS” obtains and processes your personal data only based on a specific legal basis:

  • Processing is necessary for the conclusion and/or performance of a contract;

  • You have given consent for processing for one or more specific purposes;

  • Processing is necessary to fulfill a legal obligation applicable to “OMS”;

  • Processing is necessary for the legitimate interests of “OMS” or a third party, except where your interests, fundamental rights, or freedoms override such interests. Our legitimate interests include, for example, preventing fraud, defending our interests in court, or reminding clients of warranty expiration dates.


3. Recipients and Processors (Third Parties)

“OMS” always respects confidentiality when processing personal data. Your personal data may be disclosed to other parties if necessary to conclude or execute a contract, comply with applicable law, or for other lawful reasons. Information may also be provided to other parties at your request or according to your contractual obligations with other parties.

We may provide Client personal data to third-party processors who provide services on our behalf. Processors are authorized to process personal data only under a written agreement with “OMS,” according to our instructions, and only to the extent necessary to fulfill contractual obligations. We take all necessary measures to ensure that our data processors implement appropriate organizational and technical security measures and maintain the confidentiality of personal data. Our categories of data processors include (list not exhaustive):

  • IT companies – processing data needed to maintain, develop, and improve information systems;

  • Consultants – providing legal, financial, and specialized advice;

  • Statutory third parties – ensuring contract performance;

  • Archiving and delivery service providers – processing data necessary for storage and delivery;

  • Cooperation partners performing work related to concluded contracts;

  • Healthcare institutions – processing data necessary for healthcare services;

  • Customer service quality survey companies – processing data necessary for conducting surveys on our behalf;

  • Debt collection companies – providing debt collection services on our behalf.


4. Transfer of Personal Data Outside the EU/EEA

“OMS” does not transfer your personal data outside the EU/EEA.


5. Data Storage

Client personal data is stored in printed documents and/or in our information systems.

We will retain your personal data no longer than necessary for the purposes of data processing or as required by law. The storage period depends on contracts with clients, legal requirements, or the legitimate interests of “OMS”. In practice, personal data is retained as long as reasonable claims may arise from contractual relations. Data no longer needed is destroyed or anonymized so that the data subject cannot be identified.

Even if you terminate a contract and stop using our services, we must continue to store your personal data for potential future claims until the retention period expires. Information is also retained to provide necessary information to you, maintain proper history of relations with “OMS,” and respond to any inquiries regarding our cooperation.

Your consent to direct marketing (if given) is valid for 24 months from the date it is provided. If consent is provided multiple times, the last given consent applies. You may review, change, or withdraw your consent at any time via the website www.OMS.lv or by sending an email to oms@oms.lv.

When processing personal data, “OMS” follows the principle of data minimization, meaning data is processed only to the extent and for as long as necessary for the specified purpose. We aim not to retain outdated or unnecessary information and ensure that personal data and other information are accurate and up-to-date.


6. Client Rights Related to Personal Data Processing

As a data subject, you have the following rights:

  • Obtain information on whether “OMS” processes your personal data and, if so, access your personal data, including its source, purpose, retention period, and recipients. Note that your access rights may be restricted by laws protecting other individuals’ privacy or our operational practices;

  • Request correction of personal data if inaccurate, incomplete, or incorrect;

  • Request deletion of data related to you (right to be forgotten) if “OMS” has no legal basis or other justification for processing;

  • Withdraw consent to personal data processing if the data is processed based on consent;

  • In certain cases, object to or restrict personal data processing;

  • Not be subject to fully automated decision-making, including profiling, if it has legal effects or similarly significant impact, except when necessary to conclude or execute a contract, permitted by law, or explicitly agreed by the client;

  • Request deletion of personal data processed solely based on consent if you withdraw such consent, unless other legal grounds apply;

  • Restrict personal data processing in cases provided by law, e.g., when disputing accuracy;

  • Request to receive personal data in a structured, commonly used, machine-readable format and, if possible, transmit such data to another service provider (data portability), applicable when processing is based on a contract or consent and automated;

  • Object to personal data use for direct marketing, including related profiling;

  • File a complaint with the EU authority if you believe your personal data is processed in violation of applicable laws.


7. Cookies

The company reserves the right to update this privacy policy at any time to ensure compliance with applicable laws and company operational principles.

SIA "OMS" was founded in Liepaja, 1991 and is one of the largest electric installation workers on the Kurzeme side. OMS is a licensed company for electrical installations. Company Construction Code Reg. No.: 0365-R. The main activity of OMS is the design, assembly, operation and repair of electrical installations, measurements and adjustments of the inspection.
